By making a booking and paying the deposit, the customer confirms that they have read, understood, and accepted the following General Terms and Conditions. These form an integral and binding part of the travel agreement with WANDLAY GmbH. These General Terms and Conditions apply to all bookings made from 15 July 2025 onwards, until replaced by a newer version.
1. Deposit
1.1 A deposit is required if the total price per person exceeds EUR/USD/CHF 5,000. For amounts below this threshold, full payment is due immediately.
1.2 The deposit amounts to 35% of the total travel price and must be received within 10 calendar days of booking confirmation. The booking is not binding until the deposit has been received.
1.3 In case of cancellation, 20% of the total booking value is non-refundable under all circumstances. The remaining portion may be refunded depending on the timing of cancellation (see Section 4).
2. Full Payment
2.1 For bookings of EUR/USD/CHF 5,000 or less, the full amount is due within 10 calendar days of booking confirmation.
2.2 For bookings above EUR/USD/CHF 5,000, a deposit according to Section 1 applies. The remaining balance must be paid no later than 60 calendar days before departure.
2.3 Failure to make full payment by the applicable due date may result in cancellation without refund of any amounts already paid.
2.4 All payments are binding and non-refundable, unless otherwise provided in the cancellation policy set out in Section 4.
3. Changes
3.1 Changes to travel dates can be requested up to 90 days before departure. Subject to availability, the deposit can be converted into a travel credit for a future booking.
3.2 Name changes and other modifications are not guaranteed. Any individual requests must be approved in writing by WANDLAY.
4. Cancellation & Refund
4.1 Cancellation up to 60 days before departure (via e-mail): 80% of the total amount will be refunded. 20% remains non-refundable.
4.2 Cancellation between 59 and 0 days before departure (via e-mail): No refund is granted.
4.3 Failure to travel (e.g. due to visa issues or personal circumstances) does not entitle the participant to any reimbursement.
5. Liability
5.1 WANDLAY strives to ensure that all travel services are carried out with the greatest possible care and in accordance with the planned itinerary. However, unforeseen circumstances beyond WANDLAY’s control may impact the course of the trip.
5.2 To the extent permitted by law, WANDLAY shall not be liable for any damages arising from slight or gross negligence, third party actions, force majeure events, missed connections or consequential damages such as lost profits.
5.3 In the event of force majeure (including but not limited to natural disasters, pandemics, wars, civil unrest, or government-imposed travel restrictions), WANDLAY is released from its contractual obligations. In such cases, no refunds shall be issued.
5.4 WANDLAY strongly recommends that all travelers obtain a comprehensive travel insurance policy, which includes coverage for medical emergencies, trip cancellation, and disruptions due to force majeure events. If travelers choose not to obtain such insurance, they assume the full financial risk of cancellations, delays, or interruptions beyond WANDLAY’s control. No compensation or refund will be granted in such cases.
5.5 WANDLAY’s liability, where applicable, is in any case limited to the amount paid by the customer for the affected travel.
6. Health and Fitness to Travel
6.1 Each customer is responsible for ensuring that they are physically and mentally fit for the trip. WANDLAY does not assume any responsibility for personal health-related incidents during the journey.
6.2 Participants are responsible for ensuring that all required travel documents (e.g. valid passport, visa, vaccination certificates) are obtained and carried with them. WANDLAY does not assume any responsibility for denied entry due to incomplete or incorrect documentation.
6.3 Participants must inform WANDLAY in advance of any physical or mental conditions that could affect their ability to participate in the trip. WANDLAY reserves the right to exclude participants from certain activities if health or safety concerns arise.
6.4 Participants are expected to behave respectfully toward local communities, fellow travelers, and WANDLAY staff. In cases of serious misconduct, WANDLAY reserves the right to exclude individuals from the trip without refund.
6.5 No refunds or liability claims shall be accepted due to illness, lack of fitness, or failure to meet entry requirements (e.g. vaccines, visas).
7. Cancellation by WANDLAY (Group Travels Only)
7.1 For group travels, WANDLAY reserves the right to cancel the trip if the minimum number of participants is not reached or if other operational or safety-related reasons make the execution of the trip unreasonable.
7.2 In such cases, all payments already made will be refunded in full. No further compensation or liability shall apply. Participants are advised to obtain appropriate travel insurance to cover any costs not reimbursed by WANDLAY.
8. Data Protection
8.1 Personal data provided during booking is stored and processed electronically for the purpose of fulfilling the travel arrangement. Data may be shared with third parties (e.g. local providers) only if required for execution of the trip.
8.2 If an e-mail address is provided during booking, it may be used to share travel-related information. Customers can object to this at any time.
9. Applicable Law and Jurisdiction
9.1 All contractual relations between WANDLAY and the customer are governed exclusively by substantive Swiss law, excluding conflict-of-law rules and international treaties (e.g. CISG).
9.2 The place of jurisdiction is Zurich, Switzerland. WANDLAY reserves the right to bring an action at the customer’s place of residence or registered office.
9.3 If any provision of these General Terms and Conditions is or becomes invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a valid one that comes as close as possible to the intended economic purpose.
